Terms of Service

Effective September 27, 2026. These terms are a binding agreement between you and Dvwmd LLC, a Wyoming limited liability company doing business as Mobilefy (“Mobilefy”, “we”). By creating an account, starting a trial or paying for a plan, you accept them.

1. Who we are

Mobilefy is operated by Dvwmd LLC, 30 North Gould Street, Sheridan, WY 82801, United States. Contact: contact@mobilefy.app. Charges on your card statement and invoices may show Dvwmd LLC or Mobilefy.

2. The service

Mobilefy provides a merchant dashboard, Shopify catalog sync, a visual app builder, a storefront runtime, push tooling and hosted Android/iOS builds. Shoppers check out on Shopify; Mobilefy is not a party to sales between you and your customers.

3. Accounts and eligibility

The service is for businesses only. You must be at least 18, provide accurate account information, keep your credentials secure, and have authority to connect every Shopify store you link. You are responsible for activity under your account.

4. Plans, free trial and billing

Paid plans include a 7-day free trial. A payment method is collected when the trial starts; unless you cancel before the trial ends, your plan starts automatically and is charged at the price shown at checkout. Plans renew automatically each month or year until cancelled. Prices are shown in EUR and exclude taxes; applicable taxes (such as VAT) may be added based on your billing details. Payments are processed by Stripe. If a payment fails, we may retry it and suspend paid features until it succeeds.

If you installed Mobilefy from the Shopify App Store and are billed through Shopify, Shopify’s billing terms apply to those charges and they appear on your Shopify invoice.

5. Cancellation

You can cancel at any time from Billing in your dashboard. Cancellation takes effect at the end of the current billing period; you keep access until then and are not charged again.

6. Refunds

Monthly plans are non-refundable, including for partially used periods. For annual plans and the annual App Hosting add-on, you may request a full refund within 14 days of the first annual charge by writing to contact@mobilefy.app. After that, annual fees are non-refundable. Nothing in these terms limits refunds required by applicable law.

7. Your content and stores

Your catalog, branding, customer data and campaigns remain yours. You grant us a limited licence to host, process and display that content solely to provide the service. You are responsible for your content, your push messages, and your compliance with laws that apply to your business.

8. App store publishing

Publishing to Google Play or the Apple App Store may require your own developer accounts, signing keys and store listings. You are responsible for complying with store policies. Store review decisions are outside our control.

9. Acceptable use

You may not use the service to send spam or unlawful messages, infringe others’ rights, distribute malware, attempt to access other tenants’ data, or resell the service without our written agreement.

10. Data protection

Our Privacy Policy describes how we handle account data. When we process your shoppers’ personal data on your behalf, our Data Processing Addendum applies and is part of these terms.

11. Changes to the service and prices

We may improve or change features. We will give at least 30 days’ notice by email or in the dashboard before a price increase takes effect on your subscription; you may cancel before it applies.

12. Suspension and termination

We may suspend or terminate accounts that breach these terms, fail to pay, or create security or legal risk. On termination you may export your data for 30 days, after which we may delete it.

13. Disclaimer

The service is provided “as is” and “as available”. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not guarantee uninterrupted or error-free operation.

14. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or lost profits or revenue. Our total liability for any claim is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

15. Indemnity

You will defend and indemnify Dvwmd LLC against third-party claims arising from your content, your store, your push messages, or your breach of these terms.

16. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Courts located in Wyoming have exclusive jurisdiction, unless mandatory law where you are established provides otherwise.

17. Changes to these terms

We may update these terms. Material changes will be notified by email or in the dashboard at least 15 days before they apply. Continued use after that date means you accept the updated terms.
